Acceptance of these terms
These Terms of Service govern your access to and use of Smoketest, including our website, applications, APIs, browser-run features, and related services.
Smoketest is operated by Sayfun Studio, a company based in the Netherlands, registered under KvK number 42034313 and VAT ID NL005445100B28. In these terms, “Smoketest”, “we”, “us”, and “our” refer to Sayfun Studio and any entity that operates the service on its behalf, including any successor trade name or operating entity.
By creating an account, accessing the service, or using Smoketest on behalf of an individual or organization, you agree to these terms. If you use the service for an organization, you represent that you have authority to bind that organization.
Eligibility
You must be at least 16 years old to use Smoketest. If you are using the service on behalf of a business or other entity, you must have the authority to accept these terms for that entity.
Smoketest is intended primarily for professional and business use. You may not use the service if doing so would violate applicable law, third-party terms, or contractual restrictions that bind you.
Accounts and workspace responsibility
You are responsible for maintaining the confidentiality and security of your account, controlling access to your workspace, and ensuring that authorized users comply with these terms.
Permitted use and restrictions
You may use Smoketest only in compliance with applicable law and these terms.
- Use Smoketest only on systems, environments, and accounts you own or are authorized to test.
- Do not use the service to gain unauthorized access to third-party systems, data, or networks.
- Do not use the service for scraping, spam, credential abuse, vulnerability exploitation, bypassing security controls, or activity that resembles unauthorized security testing.
- Do not submit malware, unlawful content, payment card data, government identifiers, health data, criminal-offence data, or other highly sensitive data unless we have expressly agreed in writing.
- Do not use real customer credentials or production secrets where dedicated test accounts, test data, or scoped credentials would reasonably work.
- Do not interfere with, disrupt, overload, probe, or reverse engineer the service except where applicable law clearly permits it despite this restriction.
- Do not use the service in a way that could create unreasonable security, privacy, or operational risk for Smoketest, our providers, or other users.
Customer content and permissions
You retain ownership of the tests, prompts, URLs, credentials, run artifacts, and other content you submit or generate through use of the service, subject to the rights you grant to us in these terms.
You grant Smoketest a non-exclusive, worldwide, limited right to host, copy, transmit, process, display, and otherwise use your content as necessary to provide, secure, support, and improve the service and to comply with law.
You represent and warrant that you have all rights, permissions, and legal bases necessary to provide that content and to authorize Smoketest to access and interact with the systems you direct us to test.
Browser runs may capture personal data or confidential information displayed by the systems you test. You are responsible for configuring test accounts, test environments, masking, and data-minimization practices appropriate for your own legal and security obligations.
Where you enable third-party integrations such as Slack, Discord, GitHub, or deployment webhooks, you are responsible for the data that tests into those services. We act on your instructions when sending notifications to integrations you have configured.
Data processing and run artifacts
Where Smoketest processes personal data on your behalf through test execution, run artifacts, integrations, or support, our Data Processing Addendum applies unless we have agreed otherwise in writing.
Run artifacts may include recordings, screenshots, transcripts, traces, logs, results, and debugging data. Browser Use provider recordings are downloaded into Smoketest-controlled artifact storage before they are exposed through Smoketest artifact routes. Artifacts stored in Cloudflare R2 are generally deleted after 90 days. Database run metadata may be retained for longer to operate the service, show run history, maintain billing and usage records, investigate abuse or security issues, and improve reliability.
Deletion is currently handled manually. To request deletion of an account, workspace, run, or related data, contact [email protected].
AI-assisted execution and third-party services
Smoketest uses automated and AI-assisted systems as part of the core service. This may involve processing tests, prompts, credentials, run outputs, page observations, and related content through third-party service providers, including Browser Use for cloud browser execution and provider recording processing, and OpenAI for AI-assisted execution and outcome evaluation.
AI-assisted runs and results may be incomplete, incorrect, or affected by model behavior, page changes, browser conditions, or target-system behavior. AI-generated outputs, results, and summaries are informational only and may contain errors, omissions, or inaccuracies. They are not security audits, penetration-test reports, legal assessments, accessibility reviews, or professional opinions of any kind and must not be relied upon as such. Smoketest supplements but does not replace human QA, security review, legal review, accessibility review, or monitoring.
Third-party services are governed by their own terms and policies. Smoketest is not responsible for downtime, outages, or service changes caused by third-party providers outside our reasonable control.
Billing, subscriptions, and taxes
Paid plans, credits, and related purchases are billed through our payment provider. Pricing, renewal terms, included usage, limits, and applicable commercial details are presented at checkout, in the service, or in a separate order form where applicable.
Unless otherwise stated, subscriptions renew automatically until canceled. You authorize recurring charges where applicable. You are responsible for applicable taxes, duties, levies, or similar charges, excluding taxes based on Smoketest's net income.
We may change pricing or commercial terms prospectively. If we make a material adverse change to an active paid subscription, we will use reasonable efforts to provide advance notice.
Availability, changes, and beta features
We aim to make Smoketest available and reliable, but we do not guarantee uninterrupted, error-free, or perfectly accurate operation. Browser execution, recordings, logs, and results may be affected by third-party outages, customer environments, target-site changes, network conditions, or model behavior.
We may add, remove, modify, suspend, or discontinue features, integrations, limits, workflows, or interfaces from time to time. Any preview, beta, experimental, or early-access feature may be changed or withdrawn at any time.
Neither party will be liable for delays or failures caused by events beyond reasonable control, including outages or changes of third-party services, AI model providers, cloud infrastructure, internet connectivity, natural disasters, pandemics, or government action.
Intellectual property
Smoketest and its underlying software, design, branding, and related materials are owned by Sayfun Studio or its licensors and are protected by intellectual property laws.
Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business purposes. No rights are granted except as expressly stated.
Feedback
If you provide ideas, suggestions, or feedback about Smoketest, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation to you.
Suspension and termination
You may stop using the service at any time. You may also cancel paid services subject to any billing-cycle or commitment terms disclosed at purchase.
We may suspend or terminate access immediately if we reasonably believe you have violated these terms, created a security or legal risk, misused the service, failed to pay amounts due, or if suspension is necessary to protect Smoketest, our users, or third parties.
On termination, rights granted to you under these terms end, but provisions that by their nature should survive termination will remain in effect.
Indemnification
You agree to indemnify, defend, and hold harmless Smoketest and its officers, employees, contractors, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the service in violation of these terms or applicable law; (b) your content or the systems, environments, or accounts you direct us to test; (c) your violation of any third-party right, including intellectual property, privacy, or access rights; or (d) any claim that your use of the service caused damage to a third party. We will notify you promptly of any such claim and cooperate reasonably in its defense.
Disclaimers
To the maximum extent permitted by law, Smoketest is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that the service will be uninterrupted, secure, accurate, or error-free.
Limitation of liability
To the maximum extent permitted by applicable law, we and our affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenues, lost business, loss of goodwill, loss of data, or business interruption arising out of or related to the service or these terms.
To the maximum extent permitted by law, our aggregate liability for all claims arising out of or relating to the service or these terms will not exceed the total amount paid by you to Smoketest for the service during the twelve months preceding the event giving rise to the claim.
General terms
These terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Netherlands.
Any disputes arising out of or relating to these terms or the service will be submitted to the competent courts of Amsterdam, the Netherlands, unless mandatory law requires otherwise.
We may update these terms from time to time. For material changes that adversely affect active paid subscribers, we will provide at least 30 days' advance notice by email or in-product notification before the change takes effect. Your continued use of the service after the effective date constitutes acceptance of the updated terms.
If any provision of these terms is held unenforceable, the remaining provisions will remain in full force and effect. These terms, together with our Privacy Policy, Data Processing Addendum, and any order form or separate written agreement that applies to you, form the entire agreement between you and Smoketest regarding the service.
